1. Agreement
This website (“Carnot Website”) is owned by Carnot Capital AG (“Carnot”), a company domiciled in Switzerland. The term Carnot Website refers to all domains registered or owned in the name of or on behalf of Carnot. The Carnot website is for information purposes only. Carnot takes every care to ensure that the information is correct at the time of publication. Carnot cannot give any explicit or implicit assurance or warranty (including liability towards third parties) with regard to the correctness, reliability or completeness of the information. The information published on the Carnot website may be changed at any time and without prior notice. Information once published on the Carnot website must therefore not be understood to mean that circumstances have not changed since publication or since notification to the supervisory authority or that the information is still up to date since its publication. Persons who access or use information on the Carnot website (for their own purposes or for a third party) agree to the following conditions.
This legal notice may be updated at any time. Carnot therefore recommends that you re-read this disclaimer regularly to familiarize yourself with any changes. The update date is indicated below.
2. Use of The Carnot Website / Property Rights
The entire content of the Carnot website is protected by copyright (all rights reserved). You may download or print out individual pages and/or sections of the Carnot website provided that you do not remove any copyright or other proprietary notices. If you download software or other data from the Carnot website or reproduce it in any other way, all property rights remain with Carnot. The (complete or partial) systematic reproduction, transmission (electronically or by other means), modification, linking or use of the Carnot website for public or commercial purposes is prohibited without the prior written consent of Carnot.
3. No Offer or Investment Advice
The information and documents provided on the Carnot website are made available by Carnot exclusively for personal use and informational purposes. The information and documents may be changed at any time and without prior notice. Carnot does not guarantee (neither explicitly nor implicitly) the accuracy, completeness, or timeliness of the information and documents published on the Carnot website. Carnot is particularly not obligated to remove outdated information from the Carnot website or explicitly mark it as such. The information on the Carnot website does not constitute decision-making aids for economic, legal, tax, or other advisory questions, nor should investment or other decisions be made solely based on this information. Investments in the investment instruments described on the Carnot website should only be made after thoroughly reviewing the relevant prospectus or fund contract (fund regulations), as well as the annual or semi-annual report and the articles of association (if applicable), containing all the relevant legal basis information. Consultation with a qualified professional is recommended in every case.
4. Without Guarantee
No guarantee is provided for the accuracy of the information and opinions disseminated via the Carnot website, whether explicitly or implicitly.
5. Limitations of Liability
Under no circumstances, including but not limited to negligence, shall Carnot be liable for any losses or damages of any kind, including but not limited to direct, special, indirect, or consequential damages, arising from or in connection with access to, use of, performance of, or inquiries to the Carnot website, or from linking to other websites, even if Carnot has been advised of the possibility of such damages.
Furthermore, Carnot disclaims any liability for unauthorized manipulations of the IT system of the internet user. Carnot expressly points out the risks of viruses, so-called malware and spyware, as well as the possibility of targeted hacking attacks. To combat viruses, it is recommended to use the latest browser versions and to install up-to-date antivirus software. Emails from unknown sources and emails with unexpected attachments should generally not be opened.
6. Linked Websites
If you activate certain links on the Carnot website, you may leave the Carnot website. Carnot does not review the sites linked to the Carnot website and assumes no responsibility for their content, or for the products, services, or other offers provided on those sites.
7 Forward-looking statements
The future performance of an investment cannot be inferred from past price developments, meaning the value of an investment may increase or decrease. The preservation of invested capital cannot be guaranteed; for instance, exchange rate fluctuations may cause changes in the value of an investment.
The Carnot website may contain “forward-looking statements.” While such forward-looking statements reflect the views and future expectations of the respective fund providers, a number of risks, uncertainties, and other factors may cause actual developments and results to differ significantly from those anticipated by the fund providers. Carnot is not obligated (and expressly disclaims any such obligation) to update or amend forward-looking statements based on new information, future events, or other reasons.
8. Local Legal Restrictions
The site is intended exclusively for legal entities and natural persons residing or domiciled in countries where the investment funds or their respective sub-funds or share classes are duly authorized or permitted for public distribution, offering, or sale under applicable local laws. The Carnot website contains information and documents about numerous investment funds and is not intended for individuals subject to a legal jurisdiction that prohibits the publication of or access to the Carnot website (due to the nationality of the individual, their tax domicile, or other reasons). Persons subject to such local restrictions are prohibited from accessing the Carnot website.
9. Investor Type and Localization
Users of the Carnot website must specify their personal investor type and, if applicable, their domicile upon first access. The information and documents regarding investment funds subsequently provided are intended exclusively for users who correspond to the selected investor type and domicile. An incorrectly selected investor type may result in access to information and documents about investment funds that are not intended for the user. Users are obligated to correctly indicate their investor type and domicile. Carnot cannot be held liable for damages or inconveniences incurred by users as a result of providing incorrect investor type information.
For clarification, users in Switzerland are advised that the term “Professional Investor” in the selection fields refers to a Qualified Investor as defined in Article 10 paragraphs 3, 3bis, or 3ter of the Swiss Collective Investment Schemes Act (“CISA”). The term “Private Investor” in the selection fields refers to an investor who does not qualify as a Qualified Investor under the aforementioned definition.
10. Investment Risks
Investors should be aware that shares in investment funds involve investment risks, including the possible loss of the capital invested. Past performance or returns are not guarantees of or indicators for future performance or returns. The value of an investment in a fund, as well as the income generated from it, fluctuates, so the redemption value of an investor’s shares may be above or below the original purchase price. Due to ongoing market volatility, the performance of funds may be subject to significant short-term fluctuations.
Furthermore, investment funds that primarily invest in emerging markets and/or in small-cap companies and/or in high-yield bonds are generally subject to higher risks. Please read the investment policy in the legal prospectus or fund regulations (agreement) to learn about the specific risks associated with a particular fund. Funds may also invest in foreign currencies (relative to the reference currency of the respective fund), which adds the additional risk of exchange rate fluctuations.
11. Ratings
Ratings from various rating agencies may be published on the Carnot website. The copyrights for these ratings belong to the respective rating agency that issued the rating. Caution is advised when using ratings, as they do not take into account your individual, personal circumstances. Therefore, a rating should never be considered a recommendation to buy, sell, or hold a particular investment product.
Neither the rating agencies nor Carnot guarantee that the ratings published on the Carnot website are current, accurate, or complete. The rating agencies whose ratings are published on the Carnot website, as well as Carnot itself, expressly disclaim any liability for direct or indirect damages, expenses, or losses that may arise from the use of a rating.
